Notarial minutes are public instruments in which notaries, upon the request of a party in all cases, will extend and authorize, recording the facts and circumstances they witness or know and which by their nature are not the subject of a contract.

All of them are regulated in Section 4 of Chapter II of Title IV of the Decree of June 2, 1944, which approved the Regulation of the organization and regime of the Notary.

TYPES OF MINUTES:

1. - MANIFESTATION MINUTES:

Attesting to what a person has said or manifested and when they did so.

2. - PRESENCE MINUTES:

The notary is required to appear in a specific place and attest to the state of a certain asset at a specific time, being able to take photographs of it if necessary.

3. - REQUEST MINUTES:

The Notary is requested to question someone about something or to carry out a certain act, leaving a better record of it and the response of the requested party.

4. - MINUTES OF COMPANY MEETINGS:

The notary is required to record the statements, claims, documents and agreements adopted at the Board of a company.

5. - MINUTES OF DEPOSIT OF GENERAL CONDITIONS:

The notary records in writing those contractual conditions that a company includes in its contracts. This way, it can be proven to third parties that the conditions were in force at a given time.

6. - BALANCE FIXATION MINUTES:

The notary, through the appropriate calculations, certifies the resulting balance of a specific account or debt.

7. - CONTEST MINUTES:

Through the presence of the notary in a contest, it is certified that there has been no manipulation of the results and, if applicable, the randomness of the selection.

8. - PROTOCOLIZATION MINUTES:

Those in which the notary incorporates into its file, the content of which is reserved and cannot be manipulated, the legal and legitimate documentation that the interested party desires.

9. - REGISTRATION MINUTES:



Requirements:

Registration Records:

- Property titles of the interested parties.

- ID card

- If a company is involved, the current powers or appointment of administrators.

- Registration data in the Commercial Register.

- Cadastral reference (last IBI receipt).

- Value assigned to the properties.

At the time of the initial signing, two witnesses must be provided to certify the reality of the ownership of the property.

Afterwards, edicts will be published in the City Hall where the property is located.

For other minutes:

- ID card of the interested parties.

- If a company is involved, the current powers or appointment of administrators.

- Subject matter of the minutes, whether it is presence, notification, request, etc.

In the case of minutes to certify the identity of photographs with reality, it is necessary to provide two identical sets of photographs of what is to be accredited at the time of the request.
